EVENT TERMS & CONDITIONS

(“Kodiak”, “we”, “us”, “our”).
1. EVENT OVERVIEW
The Kodiak Great Aussie Drop Bear is a live outdoor promotional activation involving the aerial delivery of empty insulated tumblers via drone within a designated drop zone.
Participation is voluntary and subject to these Terms & Conditions.
2. ELIGIBILITY
- Participation is open to all persons.
- Participants under 18 years of age must be accompanied by, and have the consent of, a parent or legal guardian.
- Kodiak reserves the right to refuse participation to any individual who does not comply with event instructions or safety requirements.
3. DRONE OPERATIONS
- Drone operations are conducted by Flying Glass, a licensed and insured commercial drone operator operating in accordance with Civil Aviation Safety Authority (CASA) regulations.
- Drones will not be handled, touched, or interacted with by participants.
- Tumblers are carried in a secure delivery device. Participants will remove the tumbler only once the drone has landed or is stationary as instructed by event staff.
- No liquids, alcohol, or hazardous items are carried by drones at any time.
4. DROP ZONE & SAFETY
- Participants must remain within the clearly marked Drop Zone and follow all verbal instructions provided by Kodiak and Flying Glass staff.
- Participants must remain alert and situationally aware at all times.
- Failure to comply with instructions may result in removal from the activation.
5. ASSUMPTION OF RISK
Participation involves inherent risks associated with outdoor events and drone operations, including but not limited to:
- Injury caused by moving equipment
- Environmental conditions (wind, heat, uneven surfaces)
- Actions of other participants
By participating, you voluntarily assume all such risks to the maximum extent permitted by law.
6. WAIVER & RELEASE
To the fullest extent permitted by Australian law, participants:
- Release and discharge Kodiak, Zen Imports Pty Ltd, Flying Glass, their officers, employees, contractors, and agents from any claims, liabilities, losses, damages, or injuries arising from participation in the event.
- Agree that this waiver applies except where liability cannot be excluded under Australian Consumer Law.
Nothing in these Terms limits rights that cannot legally be excluded.
7. INDEMNITY
Participants agree to indemnify and hold harmless Kodiak and its partners against any claims arising from:
- Breach of these Terms
- Failure to follow instructions
- Negligent or reckless behaviour
8. PHOTOGRAPHY & MEDIA
- The event may be photographed or filmed.
- By participating, you consent to the use of your image, likeness, and voice for promotional, editorial, and marketing purposes across all media without compensation.
- If you do not wish to appear in content, please notify event staff prior to participation.
9. PERSONAL INFORMATION
- Personal information collected is handled in accordance with the Privacy Act 1988 (Cth).
- Information may be used for event administration and future marketing communications.
- Participants may opt out of marketing communications at any time.
10. STOCK & AVAILABILITY
- Tumblers and refreshments are available while stocks last.
- One item per participant.
- No rain checks, substitutions, or transfers.
11. EVENT CHANGES & CANCELLATION
Kodiak reserves the right to:
- Modify, suspend, or cancel the event at any time for safety, operational, or unforeseen reasons.
- Make changes to these Terms where reasonably necessary.
12. GOVERNING LAW
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes are subject to the exclusive jurisdiction of NSW courts.

By registering and participating, you confirm that you have read, understood, and agree to these Terms & Conditions.
